Geneoscopy | Colosense: SMS Terms and Conditions Statement

  1. By voluntarily opting into the Geneoscopy ColoSense Text Message Program (the “Program”), you consent to receive text messages from or on behalf of Geneoscopy under the Program. These text messages may include notifications and updates about, as well as results relating to, your ColoSense test order. These Terms and Conditions govern your participation in the Program. Notice under HIPAA: Please note that by providing your mobile phone number, you acknowledge that text messages from the Program, which may include some limited protected health information, will be sent to the number you provide. This information may be viewed by whoever has access to that mobile phone or the carrier account. Messages sent as part of the Program are unencrypted. Unencrypted messages may be intercepted or received by unintended third parties and stored or archived by service providers and system operators. When you opt-in to the Program using the enrollment form provided by your healthcare provider, you will begin receiving text messages from or on behalf of Geneoscopy, Inc. Message and data rates may apply. Message frequency may vary.
  2. You acknowledge that participation in the Program is entirely voluntary, and that enrollment in the Program is not a condition of your ColoSense test order. If you would like to stop receiving text messages as part of the Program, reply “STOP” to any Program text message you receive or contact us at 1-800-305-8299 to speak to a Geneoscopy Customer Support representative. Please note that opting-out of text messages will only opt you out of the Program; you will remain opted-in to any other Geneoscopy text message program(s) to which you may have separately opted-in. After receiving your “STOP” text message, we may send you a text to confirm that you have opted-out of the Program. You will no longer receive text messages regarding the Program after this confirmation. You may rejoin the Program by signing up again at any time.
  3. By opting into the Program, you represent that you are the account holder for the mobile telephone number(s) that you provide to opt-in to the Program. You are responsible for notifying Geneoscopy immediately if you change your mobile telephone number or if you lose or otherwise no longer possess your mobile device linked to the telephone number you have provided for participation in the Program. You may notify Geneoscopy of a number change by contacting us at 1-800-305-8299 to speak to a Geneoscopy Customer Support representative.
  4. To request more information or assistance, reply “HELP” or contact us at 1-800-305-8299 to speak to a Geneoscopy Customer Support representative.
  5. Message and data rates may apply to each text message sent or received in connection with the Program, as provided in your mobile telephone service rate plan (please contact your mobile telephone carrier for pricing plans) and any applicable roaming charges. Charges are billed directly to you and payable by you to your mobile service provider or deducted from your prepaid account held with your mobile service provider. Geneoscopy does not impose a separate fee for sending text messages.
  6. Data obtained from you in connection with the Program may include your telephone number, your carrier’s name, and the date, time, and content of your Program text messages. Geneoscopy may use this information to contact you and provide the services you request from us, and as further described in our corporate Privacy Policy and Notice of Privacy Practices Under HIPAA, each of which is incorporated by reference into these Terms and Conditions.
  7. Geneoscopy does not guarantee text messaging availability at all times and will not be liable for any failures or delays in receiving text messages, inaccurate or incomplete message content, or damages resulting from reliance on text messages.
  8. You agree to defend, indemnify and hold harmless Geneoscopy, its officers, directors, affiliates and agents, and any third parties texting you under the Program on Geneoscopy’s behalf in full for all claims, expenses, and damages related to or caused in whole or in part relating to you voluntarily providing Geneoscopy a telephone number for participation in the Program that is not owned by you and/or by your failure to notify us if you change your telephone number or no longer possess your mobile device, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act or any state law equivalent.
  9. Geneoscopy may suspend or terminate your receipt of text messages if it believes you are in breach of these Terms and Conditions. Your receipt of text messages is also subject to termination if your mobile telephone service terminates or lapses. Geneoscopy reserves the right to modify or discontinue, temporarily or permanently, all or any part of the text messaging services you receive as part of your voluntary participation in the Program, with or without notice.
  10. Geneoscopy may revise, modify, or amend these SMS Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect upon posting to our website. You agree to review these SMS Terms and Conditions periodically to ensure that you are aware of any changes. Your continued consent to receive text messages will indicate your acceptance of any changes.
  11. You represent and warrant to Geneoscopy that you have all necessary rights, power, and authority to agree to these Terms and Conditions and perform your obligations hereunder, and nothing contained herein or in the performance of such obligations will place you in breach of any other contract or obligation. If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the other terms hereof will otherwise remain in full force and effect and enforceable.
